What the right covers
In England, many GP referrals for a first mental-health outpatient appointment carry a legal right to choose a clinically appropriate provider and team. NHS England guidance notes that some remotely delivered ADHD and autism assessments may also fall within patient-choice rights.
It does not apply in every situation
Urgent and crisis care, some onward referrals, and several other circumstances are excluded. Do not assume a provider is eligible simply because it advertises ADHD or autism assessments.
Before asking your GP
Check that the provider holds the appropriate NHS contract for the service, accepts the type of referral you need, and clearly explains whether it offers assessment only or also medication/titration and follow-up. Ask what happens after diagnosis before changing pathway.
A simple GP conversation
You can ask: “Does patient choice apply to this referral, and are there clinically appropriate NHS-contracted providers I can choose from?”
